General Terms and Conditions of Sale

Effective Date: 31.12.2025

QargoKraft operates as a freight forwarder and logistics service provider, arranging transportation and related services as an agent on behalf of the Carrier/Customer. Unless expressly agreed in writing, the Company does not act as a carrier and does not assume carrier liability.

1.Scope of Services

Our services may include, but are not limited to:

▪ Air, sea, and road freight forwarding

▪ On-Carriage, Pre-Carriage & Customs clearance

▪ Cargo documentation and logistics support

All services are provided subject to availability, operational constraints, and applicable laws.

2. Governing Transport Documents

2.1 Ocean Freight - Bill of Lading (B/L)

All ocean shipments are subject to the terms and conditions of the applicable Bill of Lading issued by the ocean carrier or its authorized agent.

In case of any conflict, the Bill of Lading terms shall prevail and be governed by applicable international maritime conventions and local laws

2.2 Air Freight - IATA Air Waybill (AWB)

All air shipments are subject to the IATA Air Waybill in terms and conditions, and international conventions including the Montreal Convention or Warsaw Convention, as applicable.

3. Customer Responsibilities

Customer is solely responsible for:

▪ Providing complete, accurate, and lawful shipment information

▪ Proper packing, labeling, and securing of goods

▪ Declaring dangerous, restricted, or regulated cargo

▪ Compliance with export, import, customs, and security regulations

The Customer shall indemnify the Company against any loss, damage, fines, or penalties arising from incorrect information or non-compliance.

4. Pricing, Charges & Payments

▪ All quotations are based on information provided by the Customer and may be revised if details change

▪ Charges may vary due to fuel surcharges, carrier adjustments, currency fluctuations, or regulatory costs

▪ Duties, taxes, demurrage, detention, storage, and inspection charges are the Customer’s responsibility

▪ Cargo will not be released until all outstanding charges are paid in full

5. Customs & Regulatory Matters

QargoKraft may assist with customs clearance as an agent only.
We are not responsible for delays, inspections, seizures, or penalties imposed by customs or government authorities.

6. Insurance

Cargo insurance is not included unless specifically requested in writing and confirmed both parties(Customer & QargoKraft)
If insurance is arranged, it is subject to the insurer’s terms, conditions, and exclusions.

Failure to request insurance means the Customer accepts the risk of loss or damage.

7. General Limitation

QargoKraft liability, if any, is strictly limited to:

▪ The liability limits stated in the applicable Bill of Lading or Air Waybill, or Applicable international conventions and local laws

QargoKraft shall not be liable for:

▪ Indirect or consequential loss

▪ Loss of profit, market, or business opportunity

▪ Delay, unless caused by proven gross negligence

When QargoKraft Is Not Liable

The company shall not be responsible for loss, damage, or delay caused by:

▪ Acts or omissions of carriers, ports, terminals, or third parties

▪ Insufficient packaging or labeling

▪ Customs inspections or regulatory actions

▪ Force Majeure events (see Section 8)

8. War, Conflict & Force Majeure

The Company shall not be liable for any loss, damage, delay, or failure to perform caused by events beyond its reasonable control, including but not limited to:

▪ War, armed conflict, military action

▪ Sanctions, embargoes, or government restrictions

▪ Strikes, riots, or civil unrest

▪ Natural disasters, pandemics, or port congestion

In such cases, the Company may suspend, reroute, or terminate services without liability. Any additional costs incurred shall be borne by the Customer.

9. Claims & Time Limits

▪ Any claims must be submitted in writing within the time limits specified in the applicable Bill of Lading or Air Waybill

▪ Claims submitted outside these time limits shall not be accepted

10. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of the country where QargoKraft operates will apply, and any disputes shall be subject to the exclusive jurisdiction of its courts unless otherwise agreed in writing.

11. Acceptance of Terms

By using our website, requesting a quotation, or booking a shipment, the Customer confirms acceptance of these Terms & Conditions.
